Privacy policy

The short version
When you submit a form on this site, the information you provide goes to Karena Kaz Arianna-Zhian (Kaz) so she can respond. The site also runs Microsoft Clarity — a session-replay and heatmap tool — to help Kaz understand how visitors use the site. Clarity does not collect form field contents, passwords, or personally identifying account data, and it offers an opt-out you can use at any time.
What information we collect
Information you provide in a form
- Tour request, callback request, agent registration, newsletter signup: name, email, phone (if provided), the community you asked about, and any notes you wrote.
- Floating-contact form: name, email, phone (optional), interest category, message.
Information collected automatically
- Server logs (Netlify): IP address, user agent, request URL, timestamp, response status. Used for operating the site and preventing abuse. Retention follows Netlify's policy.
- Microsoft Clarity: aggregated session data including page navigations, clicks, scrolls, mouse movements, device type, and approximate geolocation derived from IP. Clarity also captures anonymized session recordings. Form input contents are masked by default and not collected.
How we use it
- To reply to your inquiry.
- To follow up about the community or service you asked about, if that's what you requested.
- For agent registrations, to confirm representation with the relevant builder and protect your buyer's procuring-cause status.
- For newsletter signups, to send the monthly note you opted into. Every email has an unsubscribe link.
- For Clarity data, to see which pages confuse visitors so Kaz can rewrite them.
What we do not do
- We do not sell or rent your personal information. (Sale or sharing as defined under California / Oregon consumer-privacy laws.)
- We do not run advertising pixels — no Facebook, X, LinkedIn Insight, or Google Ads tag.
- We do not load Google Analytics.
- We do not use cross-site behavioral retargeting.
- Clarity does not capture passwords, credit card numbers, or other sensitive form input. Microsoft masks these fields by default.
Microsoft Clarity specifically
Microsoft Clarity (clarity.microsoft.com) is a behavioral-analytics product from Microsoft. On this site it runs with the project ID wtdc95khdn. Clarity collects usage data via cookies (see the cookie policy for the exact cookies) and short-lived session storage. Data is processed by Microsoft under Microsoft's Privacy Statement and the Clarity terms.
How to opt out of Clarity on this site:
- Enable your browser's Do Not Track or tracking-protection setting. Microsoft Clarity honors the standard browser opt-out signal.
- Decline analytics from the cookie banner on your next visit (we'll be adding a one-click opt-out toggle in a near-term update).
- For comprehensive opt-out across Microsoft services, visit the Microsoft Privacy Dashboard.
- Use a privacy-focused browser or extension (Brave, uBlock Origin, Privacy Badger) that blocks third-party analytics scripts.
Search-engine verification
This site is verified with Google Search Console (Google) and Bing Webmaster Tools (Microsoft) via meta tags in the page <head>. The verification process itself does not collect visitor data — it confirms our ownership of the domain. Search engines collect normal crawl data as they do with any indexed website.
IndexNow
This site participates in IndexNow (indexnow.org), an open standard for notifying search engines about new and updated URLs. When pages are deployed, the site automatically notifies the IndexNow API. No visitor data is involved.
Information sharing
- With service providers — Netlify (hosting), Microsoft (Clarity), and email delivery (for newsletter, if you subscribe) process data on our behalf under their respective privacy policies.
- With the builder — when you ask Kaz to register you for a builder community, the builder receives your name and contact information as part of the standard preferred-agent registration. This is the entire point of registration and the data flow is contractual.
- With legal authorities — if required by valid legal process or to comply with applicable law.
Your rights
Depending on where you live, you may have rights to access, correct, delete, or port your personal information; to opt out of "sale" or "sharing" as those terms are defined under California / Oregon law; and to lodge a complaint with a regulator. To exercise any of these rights, email kaz.arianna-zhian@terratahomes.com with the request and the page or form you used. Standard verification applies for sensitive requests.
California, Oregon, Colorado, Connecticut, Virginia, Utah residents
Under your applicable state consumer-privacy act you have rights to know, delete, correct, and opt out of "sale" / "sharing." We do not sell or share personal information as those terms are defined under state law. Submit requests to kaz.arianna-zhian@terratahomes.com.
European Economic Area / United Kingdom residents
If you are in the EEA or UK and engage with this site, the lawful basis for processing your data is your consent (forms, newsletter) or our legitimate interest (server logs, analytics for site improvement). You have the rights set out in GDPR / UK GDPR Articles 15–22. Contact kaz.arianna-zhian@terratahomes.com to exercise them.
Children
This site is intended for adults. We do not knowingly collect information from anyone under 18.
Security
Form submissions transmit over HTTPS to Netlify Forms and forward to Kaz via email. Spam protection uses Netlify's honeypot field. The site enforces strict Content-Security-Policy, X-Frame-Options DENY, and HSTS with preload. Real estate licensee records are retained according to Oregon Real Estate Agency requirements.
Changes
We will update the "last updated" date when this policy changes. Material changes will surface as a banner on the homepage for at least 14 days.
